Summary/Abstract: The right to education is a fundamental right, regulated by Art. 32 of the Romanian Constitution and Law no. 1/2011 on national education, republished, in full accordance with Art. 2 of the First Additional Protocol to the European Convention on Human Rights and Art. 14 from the Charter of Fundamental Rights of the European Union. In exceptional conditions, such as the state of siege or the state of emergency, regulated by the provisions of Art. 93 of the Constitution or the state of alert, the right to education must not know any restrictions or limitations. Following the pandemic caused by SARS-CoV-2 virus, there have been significant changes in the exercise of the right to education, regulated both at the international and national levels. In this context, this article highlights the important aspects regarding the rules adopted during the pandemic, regarding the exercise of the right to education in Romania and the impact of the changes among the actors participating in the education process in our country.
