The right of detained persons to formal defense in the Polish criminal process. Evaluation of the solutions proposed in the petition of the Supreme Bar Council on taking a legislative initiative to amend Article 245 of the Code of Criminal Procedure

Summary/Abstract: The aim of the article is showing the legitimacy of the Supreme Bar Council’slegislative initiative to amend Article 245 of the Code of Criminal Procedure, aimed atimproving the legal situation of detainees and to assess of the solutions suggested by theNRA, as well. The article analyzes the current state of the law from a legal standpoint ofthe compatibility of the current regulations with the standards arising from Europeanlaw – which made it possible to identify areas of incompatibility and to examine whetherthanks to the solutions suggested by the NRA, these legal discrepancies can be removedor at least – reduced.
