Brief considerations regarding the disciplinary liability of civil servants as regulated by the Administrative Code

Summary/Abstract: The study thoroughly analyzes the regime of disciplinary liability enshrined in the Administrative Code. The analysis is done comparatively, by reference to the provisions of the old Law no. 188/1999 and, very importantly, it is also corroborated with other normative acts that contain provisions on the matter, such as, for example, Law no. 161/2003. When we found deficiencies, we formulated ferenda law proposals, which, to the extent that they will be taken into account, can improve the civil servant's liability regime.
