Summary/Abstract: The paper deals with the question of applicability of such findings which go beyond the statements of parties in contradictory civil procedure. This issue is viewed in terms of adversarial principle, the consequence of which is the unacceptability of boundless consideration of everything that came to light in the proceedings. Therefore, it is striven to find the appropriate rate of when the court has the right to go beyond the previous statements of parties. Last but not least, the focus is given to the impacts of such court action on the predictability of its decision.
