The Issue of Obligatory Defense in Criminal Proceeding – Dogmatic and Legal Considerations

Summary/Abstract: The main purpose of this study is to present and evaluate institution of obligatory defense, provided for the defendant in the Polish criminal procedural code. The article presents arguments supporting the statements that this institution is required for the party to conduct the trial in fair and lawful manner. The aim of this considerations is the presentation of the jurisprudence of the Supreme Court in the scope of raising doubts relevant to the occurrence of grounds in the trial of obligatory defense.
