Summary/Abstract: This study analyzes the constant evolution of the concept of concerted practices in the jurisprudence of the Court of Justice of the European Union. This analysis begins with the American origin of this concept and then proceeds to present how it was implemented in the European Union. Also, in order to outline the formal limits of concerted practices, increased attention will be devoted to the similarities and differences between this and the other two types of anti competitive activities provided for by Article 101 TFEU: decisions by associations of undertakings and agreements between undertakings.The second part of this study focuses on the two classifications of concerted practices but also on how they affect both procedural aspects and the evidentiary standard claimed by the European Commission. At the end of the study, two cases will be presented which, through their particularities, lead to the formation of new jurisprudential regimes.
