Summary/Abstract: The concept of "common law" generally corresponds to "customary law" which forms the basis of Turkish legal tradition. In our study, the origins of the legal systems developed in continental Europe and the legal traditions on which they are based are discussed. It has been observed that the "common law" in continental Europe differs significantly from the Roman legal system. Our study also aims to compare the European and Ottoman-Turkish legal systems within the framework of the common law, and it has been determined that there are significant similarities between them.
