Summary/Abstract: The paper discusses the issue of admissibility of a stay of the enforcement of a surety or bank guarantee under a court’s decision. Observations of the trade practice show that increasingly often obligors under such sureties or guarantees try to prevent beneficiaries from making use of these remedies by initiating interim proceedings to secure claims. The authors review nearly 20 court decisions (a majority of them unpublished) in order to discuss the jurisprudence’s stance on the possibility of issuing an interim in- junction that takes the form of a stay of the payment of a surety (guarantee) against the background of the legal characteristics of the surety and bank guarantee; they also describe individual formal re- quirements that a motion for an interim injunction needs to satisfy.
