Barrister’s third party liability against the background of third party liability insurance – remarks in the context of selected court rulings

Summary/Abstract: The issue of barristers’ third party liability is not only a complex issue, but it is also significant from the point of view of society and barristers themselves. Due to various reasons for incurring liability by barristers and lack of clear statutory definitions specifying the manner of clients’ representation and scope of du- ties, apart from indicating the statutory and professional regulations in this area, the article indicates a number of court rulings which regulate and clarify barristers’ duties towards clients and rules of respon- sibility for non-compliance with which they may face civil liability. Furthermore, the article presents bar- rister’s third party liability insurance as compulsory insurance, with particular attention paid to the spe- cific nature of the barrister’s profession. The analysis of court rulings and special terms of barristers’ compulsory third party liability insurance indicates the scope of their liability, circumstances in which it can arise, as well as possibilities of modification of barristers’ compulsory third party liability insurance.
