Summary/Abstract: The legal nature of the subsidiary liability of the members of the management bodies of the insolvent debtor is the subject of extensive doctrinal as well as practical debates in national jurisprudence. Subsidiary liability concerns only the members of the management bodies that are expressly provided for by law and only if through their actions they have contributed to the company ending up in the cessation of payments, respectively in the impossibility of executing its obligations when due and as a result, when applying the procedure of insolvency.
