Practical problems faced by a branch office of an euseated insurer operating in Poland

Summary/Abstract: The article is aimed at discussing the legal conditions of the operation of a branch of for- eign insurance companies in Poland. Such legal form of conducting insurance activity in Po- land has recently acquired significance due to Poland's membership in European Community structures, although its practical aspects remain questionable. Apart from the strictly legal issues, the article focuses on the practical aspects of conducting insurance activity in the form of a branch in Poland. In light of this article's scope, the issues relating to the principles of the establishment and operation of a branch are discussed, both in accordance with Polish law and the Community law. A number of legal aspects concerning the principles of con- ducting insurance activity are separately discussed, including the principles concerning the competences of the Polish supervisory authorities especially in relation to a branch of a for- eign insurance company. In addition, remarks have been included on the day-to-day business activity and liquidation of a branch of a foreign insurance company.
