Summary/Abstract: The continual growth of migration within the territory of member states of the European Union brings not only a legal entry and stay but also a risk of illegal entry and stay of foreigners in the territories of the EU including Schengen member states. These foreigners are afterwards, in connection with their illegal stay, sanctioned in accordance with the national law of a particular member state. Imposing sanctions in justified cases means a direct breach of the rights and freedoms of foreigners. Based on gained knowledge from the practice, this contribution highlights the consequences of increased migration in connection with functioning of the police departments.
