Summary/Abstract: The European Union acts a patron for its interests and mainly a protector of the adherence to the European law. In relation to the fact that the European Commission checks and monitors the system of state aid provision within the member states, it is eligible to make decisions based on facts and legal and economic evaluation regarding the repayment of the state aid, which has been given to the eligible subjects but not in accordance to the requirements of the European law. The article analyzes in its broader context the responsibility of the member states for the state aid provision and also pinpoints the necessity of the beneficiary to give back the aid, which was not provided in compliance with the principles of the internal EU market.
