Summary/Abstract: The will of the parties, as the base on which contract law was founded, has been the subject of an extensive critique, mostly because of its inadequacy to the current dynamics of the economy. However, in order to reach a more profound answer, the critique should also take into consideration the evolution of the way the concept is substantiated, in order to assess the validity and utility of endeavored solutions.
