Summary/Abstract: The aim of this article is to present and evaluate the functioning of the BusinessMax guarantee scheme for micro, small and medium-sized enterprises (SMEs). Aspects of the admissibility of this type of guarantee, its scope and its impact on the economy are analysed. The main research objective of the study was to determine whether, given the extent of the impact of the BiznesMax guarantee on the business sector, it is economically and legally viable. The analysis carried out concluded that the BusinessMax guarantee is one of several existing guarantee schemes. The original purpose of the guarantee was to reduce barriers to access to finance and thus support the development and business activities of innovative enterprises. However, changes introduced during the course of the programme's existence to its key parameters resulted in a significant departure from the original intent of the programme. The implemented modifications were triggered by changes in the economic environment observed during the COVID-19 pandemic. This resulted in a dynamic increase in the number of guarantees granted, however, they were granted mainly as collateral for liquidity loans, which resulted in a significant similarity to the existing de minimis guarantee scheme. Such a significant similarity calls into question the point of having two guarantee schemes that are so substantially similar, as it may cause problems in their distribution.
