Summary/Abstract: The considerations presented in this article focus on the arguments and views of Radosław Chałupniak, which support the presence of religious education in public schools. The author of the article relates the philosophical-anthropological, socio-political, cultural-historical, legal, pedagogical-didactic and theological-pastoral arguments indicated by the priest to the opponents' views of school religion classes appearing over the years. However, the aim of the article is not to discuss delegitimizing arguments, but to try to answer the question whether they are the basis to undermine the arguments justifying and at the same time legitimizing the presence of religious education in public schools in the Third Republic of Poland. The author emphasizes the fact that when we talk about arguments justifying the presence of religious education at school, we do not consider arguments put forward by specific people, institutions or representatives of various communities, but arguments developed over the years, which today can be perceived as constantly accompanying the legitimization of religious education at school and the discussions about it not only in the social dimension, but also in relation to ideas, history, culture and law.
