Summary/Abstract: The draft position of the Sejm concerns Article 25 para. 1 and 2 of the Petty Offences Code which provides for the conversion of a fine on socially useful work or to arrest, if it is a fine exceeding the amount of 500 zł. The author proves, that this provision is consistent with the Constitution. Given the differences between crimes and offences, differences in how to perform fine seem to be justified. They may not be regarded as incompatible with the constitutional principle of equality.
