Legal opinion on the bill amending Law on Broadcasting and some other acts.

Summary/Abstract: The opinion concerns the governmental bill amending Law on Broadcasting and some other acts. The bill was created due to the need for immediate implementation of Directive 2007/65/EC of the European Parliament and the Council of 11th December 2007 changing Council Directive 89/552/EEC. According to author’s opinion, the project require further work. A lot of its provision raises legislative nature questions. Due to the insufficiency of the definition of audiovisual media service on demand, fixing the subjective scope of the Act is difficult. The most serious concerns relate to the instruments of self-regulation and co-regulation (especially their legal effectiveness) and scope of obligations imposed on VOD providers.
