Legal opinion on compliance of the government bill on Educational Information System with the Constitution.

Summary/Abstract: The opinion concerns the compliance of the bill on Educational Information System (Sejm paper no. 3628) with Constitution. The fundamental problem is the compatibility of the bill with constitutional right to protect the personal data. In author’s opinion, the regulations of the bill seems to be consistent with the art. 51 of Constitution. Moreover, collecting individual data about each student is necessary to realize the constitutional obligation of providing to citizens common and equal access to the education.
