Summary/Abstract: The author claims, that Code of Civil Procedure in the extent, that does not allow the resumption of proceedings due to final sentence by the European Court of Human Rights, which states violation by the Republic of Poland the Article 6 para. 1 of the Convention for the Protection of Human Rights and Fundamental, involving deprivation of the right to court is not incompatible with Article 45 para. 1 in conjunction with Article 2, Article 8 para. 2 and Article 77 para. 2 of the Constitution. The content of Article 45 para. 1 of the Constitution does not suffice to formulate a thesis about the existence of a constitutional duty to introduce above-mentioned regulation.
