Summary/Abstract: The opinion concerns the cognition of the Federal Constitutional Court of Germany (Bundesverfassungsgericht) with regard to the EU legislative acts. The author considers whether the Court has a competence to control these acts and their compliance with the Basic Law of the Federal Republic of Germany (Grundgesetz für die Bundesrepublik Deutschland) and what are the basis of this competence. The author examines the previous judical decisions, especially the cases Solange-I and the judgment on the Treaty of Maastricht, and the voices in doctrine. The author concludes that the Court consistently acknowledges its competence to control the compliance the EU legislative acts with the German constitution and constituted the special procedure for these acts. The opinion contains also the discussion on the limits of control the EU acts: the competences of the EU and the level of protection of the fundamental rights by the European Law.
