Summary/Abstract: Eavesdropping, or actually a surveillance and recording of conversations, in a society was always the source of excitement and many fears. It is raised, that even used for the protection of superior goods, the eavesdropping remains a severe violation of civil rights. The article discussed legal base (or its lack) of implementing the kinds of eavesdropping – the so-called legal and the operative, their common relations, and a legal base (or lack of it). The authors also presented the jurisdiction of European Court of Human Rights concerning the protection of privacy and possible cases when limitation of individual rights by eavesdropping might be permitted.
