Summary/Abstract: The principle of equal treatment is one of the basic pillars of our society. Equality is today a principle promoted, publicized, regulated by the legislator, appropriated by the individuals, interpreted by the courts of law. However, its reverse, discrimination, is still a present phenomenon, far from being eliminated. That is why, through this study, we propose to analyze one of the forms of discrimination, namely the harassment, in the particular case of employment relations. Through this study we aim to provide an overview of the phenomenon of harassment at work, as it was interpreted by the courts of law, from the perspective of the four conditions of legal liability, as well as the sanctions imposed on the perpetrators of the harassment. We hope that this study will be useful to the victims of harassment, but also to the employers who have the obligation to prevent and combat the phenomenon of harassment at work.
