Summary/Abstract: The aim of the article is to present an explanation of the issue concerning the control of the transcription of a foreign civil status document. The main focus of the article is aanswering the question whether the transcription of a foreign civil status document may be subject to inspection by way of a complaint to an administrative court, as defined in Article 3 § 2 Point 4 of the Act of 30 August 2002, Law on proceedings before administrative courts (Journal of Laws of 2022, Item 329, 655, 1457, of 1855), hereinafter referred to as the law on proceedings before administrative courts. Answering the posed question posed, it should be stated that the transcription is not controlled by submitting a complaint to the district administrative court specified in Article 3 § 2 Point 4 of the Law on Proceedings before administrative courts, but is of an indirect nature and is made due to the type of deficiencies in the proceedings concerning the rectification, supplementation, or annulment of the civil status certificate, or in non-litigious court proceedings to establish its content. Due to the multiplicity and complexity of these methods, it is worth considering legislative changes consisting in the introduction of the institution of invalidating material and technical activities related to the registration of civil status by the decision of the head of the Civil Registry Office. The Author also considers the issue of who has got the right to start a procedure of control of the transcription of a foreign civil status document. Basically, it is a person who can apply for the transcription of such a document. Therefore, the Author analyses the text of Article 104 Secion 4 of the Act of 28 November 2014, Law on Civil Status Records (Journal of Laws of 2022, Item 1681), stating that the application to the application for transcription may be submitted by the person to whom the transcribed event relates or by another person who demonstrates a legal interest in transcription or a factual interest in the transcription of a document confirming the death. Due to the fact that the notions of legal and factual interests have not been defined by the legislator, in order to interpret these concepts, the Author uses the achievements of representatives of the doctrine of administrative law, who refer to the concept of E. Bernatzik. The article employs the analytical and legal method as the leading research method.
