THE STATUS OF APPEAL AMONG ORDINARY MEANS OF APPEAL

Summary/Abstract: The criminal process ensures respect for individuals’ fundamental rights and freedoms as established by international instruments and guarantees respect for the Constitution and State laws.The basic purposes, including for the courts, is to ensure effective respect for the right to a fair trial, impartial and independent judgement without any outside influence. However, in order to fulfil the duties of the courts and the procedural guarantees established, the courts are also liable to make certain errors, either in establishing the truth or in applying the law to a specific case. Thus, some judgments adopted may seriously damage the fundamental rights of the individual, with negative effects for society and the prestige of justice.
