Summary/Abstract: Globally, the recognition of the seriousness of sexual crimes has become more and more widespread, both due to the increase in the prevalence of this crime, and following a natural trend of equalizing relations between men and women, which has facilitated the reporting of these violent behaviors. Although this recognition can now be seen worldwide, in Romania not only does the crime of rape remain a still highly vulgarized subject, but also a severely under-reported crime, as there is no institutional design at this moment to criminalize this phenomenon properly, beyond the doctrine. The present paper focuses on the current legislation and institutional police practices regarding rape in Romania and the United States of America because in the American culture the paradigm and system developments in this regard have set an example worthy of following for our country, and not only. In the same direction, this paper also focuses on a critical analysis of the Romanian legislation regarding the sanction of rape, an analysis that we consider necessary for any attempt to improve the current realities in this regard.
