Summary/Abstract: Mentally retarded people are beneficiaries of all rights and freedoms appertained by able-bodied people and all the decisions concerning the legal status of an individual refer to them - including criminal law. In the literature on the subject we can find the ideas that regardless of a direct link between mental retardation and inclination to violate the law, reduced mental abilities can defi- nitely hinder social adjustment and thus lead to conflicts with the law.A reduced mental level is connected with difficulties to understand fundamental norms, legal, social and moral, as well as with inability to predict the consequences of actions taken. In case of conflicts with the law, we can notice other deficiencies related to reduced language and communication skills which significantly make communication in these specific conditions hard for mentally re- tarded people.
