Summary/Abstract: The article examines when the requirement for the immutability of the court panel in first instance criminal cases starts to apply – at the beginning of the committal proceedings as introduced to the Criminal Procedure Code (CPC) in 2017, or at the beginning of judicial investigation. Analyzing the two options, the conclusion is made that the changes to the CPC have no bearing on the requirement and it starts at the beginning of the judicial investigation.
