Summary/Abstract: An efficient system of execution and bankruptcy procedures is an essential condition for access to credit and foreign investments. The international and especially the European mobility of companies or enterprises amplifies the influence that execution procedures have on debtors who have steady business capital and other assets such as real estate, capital investments or shares in foreign companies and bank accounts in other countries different from where they reside. The time as come for secondary bankruptcy procedures after the primary ones in Albania or vice-versa. In this article we will try to define the legal obstacles to a better regulatory system of cross border bankruptcies, by comparing some important aspects of the model law of UCITRAL with the EU regulation for the bankruptcy, the Albanian legislation and that of Montenegro.
