Summary/Abstract: In a democratic society, it is essential that the courts, in exercising their jurisdictional powers, enjoy independence. One of the guarantees of the rule of law is the independence of judges and of the judiciary as a whole. For the proper functioning of a society governed by the rule of law, cases must be decided independently of any influence.
