Summary/Abstract: Performing paid work is the way most people earn income to support themselves. Any paid work entails rights and obligations for both the employee and the employer. In terms of health and safety at work, the employer has full discretion, but this does not exempt the employee from any obligation. In the case of the death of a person during the exercise of the activity, several questions arise: who will answer if the person is not legally employed, whether or not there are special legal rules or the general ones will be applied, what are the conditions under which the act will be considered criminal offence. In the article below, by presenting two related cases, a civil case and a criminal case, we tried to answer the most important questions.
