Summary/Abstract: The crime of incitement to violence, hatred or discrimination has undergone a series of changes in the constitutive content in recent years, likely to bring the national criminalization into close correlation with the Framework Decision 2008/913 JAI of November 28, 2008 of the Council on combating certain forms and expressions of racism and xenophobia through criminal law.The explicit enumeration of discrimination criteria, as well as the elimination of some requirements not foreseen by the European normative framework, had the role of making the incriminating text more predictable and easier to apply in practice.
