Summary/Abstract: The article addresses the problem of heroic virtues, identified in ethics from Aristotle onwards, in the context of the contemporary dispute over the moral and legal evaluation of eugenic abortion and abortion in situations where the mother's life is at risk. It is shown that it is unfounded to regard the moral and legal prohibition of these acts as disregarding the limits of human possibility and forcing heroic behaviour by law. The legal freedom of such types of abortion presupposes the idea of legal positivism, justifying state violence against citizens, including the legal protection of those who kill the unbelieving and defenceless.
