Curent problems in the application of Art. 343b, para 5 of the Penal Code for confiscation of motor vehicles

Summary/Abstract: This article aims to cover the international experience of confiscation of motor vehicles when alcohol and drug use is detected during driving. The legislation of most of the countries in European Union is researched, also with the legislation of Russia and the USA. It’s made an attempt to outline the main problems in the legislation of Art. 343b, par. 5 of the Criminal Code. Attention is drawn to the actions of the investigating authorities and the court decisions. The author has justified the need for legislative amendments to specifies the legislation.
