Summary/Abstract: Collecting evidence in cross-border cases can be a difficult task for competent authorities in the different member states of the European Union.Composed of different legal and judicial systems, the European Union does not have a unique set of rules enabling member states to deal efficiently and uniformly with collection and recognition of evidence. Since the adoption of Framework decisions2003/577/JHA and 2008/978/JHA, it has become clear that the existing frameworkf or the gathering of evidence is too fragmented and complicated. A new approach is therefore necessary. This new approach is based on a single instrument called the European Investigation Order /EIO/. EIO is the first instrument which realizes principles of mutual recognition and mutual trust in practice in the field of collecting of evidence in Criminal Procedure.
