Some considerations on the condition of compliance of enforcement with the enforceable title. Theoretical and jurisprudential perspectives

Summary/Abstract: Enforcement, as the final phase of the civil process, is aimed at the effectiveness of the judicial procedure, which is manifested primarily by the satisfaction of the creditor's claim and which must meet certain requirements, including the conformity of enforcement with the enforcement title. Through this study, we aim to draw some theoretical and jurisprudential landmarks that highlight the importance of the compliance requirement, ultimately circumscribed to the ultimate goal of ensuring effective access to justice, with its essential component that manifests itself at the level of enforcement.
