Summary/Abstract: Equality before the law is constitutionally enshrined. Depending on the evolution of society, at certain times, it is possible that the legislator considers it necessary, through the lens of objective reality, to grant increased protection, from the perspective of the criminal law, to a certain category of persons, namely, in the present case, the minor. Although, in essence, we can understand this new vision, we still have to highlight the fact that the amendments and additions to the criminal provisions must, on the one hand, comply with the rules of legislative technique, and, on the other hand, not lead to situations in which the application of these rules to concrete cases would be difficult to achieve.
