Summary/Abstract: With Romania's accession to the European Union, a continuous modification of our legislation is underway, and the decisions of the European Court of Justice in application of this legislation must be respected and applied by the Romanian courts, even at the risk of causing disturbances in the internal legal order. Within this framework, it is necessary to identify procedural levers in order to mitigate the risk that, through the direct application of EU law, the situation of defendants in national proceedings may be worsened precisely in the light of this law.Keywords: CJEU case law, HCCJ, Romanian criminal law
