Review of the bill strengthening the protection of the rights and welfare of the child in situations of a family breakdown

Summary/Abstract: In the author’s opinion, the aim to strengthen the protection of the welfare of the child and to improve the level of legal security for children should be considered the right direction to make changes to the law. Nevertheless, not all the proposals contained in the Senate bill fully achieve the intended purpose. The author evaluates the proposed solutions, pointing out their advantages and disadvantages. To a certain extent, the author proposes a clarification of the code provisions in order to strengthen the implementation of the principle of the protection of the child’s welfare in the judicial process.
