Summary/Abstract: The commentary addresses the issue of the admissibility of the suspect’s remote participation in pre-trial detention hearings and, in particular, in the initial remand-in-custody hearing from the perspective of Article 5(3) and (4) ECHR. Analysing the Strasbourg jurisprudence, the author concludes that the specificity of remote participation too far undermines the possibility of achieving the objectives set by the habeas corpus procedure so that the appearance before a judge within the meaning of Article 5(3) ECHR should be physical. However, in the author’s opinion, remote participation of the suspect may be the optimal solution for other detention hearings. The author also draws attention to the need to adopt additional procedural safeguards related to the remote participation of the suspect in the session and formulates de lege ferenda proposals.
