Summary/Abstract: The study critically refers to the Supreme Court’s resolution of May 28, 2021 (III CZP 27/20), according to which the right to live in a clean environment is not a personal good, and health, freedom, privacy, the violation (threat) of which may be caused by violation of air quality standards set by law, are subject to legal protection as personal goods (Article 23 in connection with Article 24 of the Civil Code and Article 448 of the Civil Code). The gloss presents critical comments on the position of the Supreme Court.
