Preventing the exercise of electoral rights

Summary/Abstract: In this paper, I tried to examine one of the crimes that are part of the group of electoral crimes, being convinced that my analysis can be useful both to students of specialized faculties in the country and to practitioners, of course, taking into account the intense activity that is being carried out this year. In the first part of the paper, I performed a retrospective examination of how this crime was mentioned in the first two Romanian criminal codes of the modern era. I have thus highlighted a certain consistency of the Romanian legislator for criminalizing this act, starting from the social danger it represents for an authentic democracy. Last but not least, I insisted on the fact that both the doctrine and the jurisprudence of those times considered this crime to be of a political nature. The work continues some research that I have carried out over time, having as its central subject the actions by which the material element of this crime is carried out.
