Summary/Abstract: For the prosecutor, the exercise of remedies is the practical means by which he fulfills his obligation to ensure that the work of the courts is conducted in accordance with the law, so that the general interests of society, the rule of law and the rights and freedoms of citizens are not affected [62, p. 274]. The effectiveness of the prosecution's case in court is not always directly related to the professional qualities of the prosecutor. The state prosecutor must convince the court of the merits of the prosecution's case and give good reasons for his position. The prosecutor must by all legal means combat the position chosen by the defence side [1, p. 280]. The article discusses some aspects of the prosecutor's participation in the examination of criminal cases in the appellate court. The authors analyse the problems of the prosecutor's participation that arise in the trial of cases in the court of appeal.
