Summary/Abstract: This paper examines whether a will is considered void if it was created for reasons that are already taken care of or for future care that has been agreed upon. It analyzes the discrepancies in case law that arise from the motives behind the will. The paper also explores the motive behind the distribution of assets in a will, focusing on the comparison between a will and a donation contract. If a testator expresses a desire for future care to be provided for them until the end of their life, it is assumed that the will is void based on Article 42, b. of the Inheritance law.
