Some comprehensive clarifications regarding the purpose, missions and fundamental principles of the contraventional process in the Republic of Moldova

Summary/Abstract: This study presents some comprehensive insights into the purpose of the contraventional process, through the prism of both the contraventional law and the opinions of the researchers from the country and abroad. In order to fulfill the purpose of the contraventional process, we have identified and elaborated on its fundamental missions.A distinct section of the research has been dedicated to the core principles of the contraventional process, outlining the foundational concepts as stipulated in the contraventional legislation and establishing some specific principles of the contraventional process (legality, equality, presumption of innocence, individualization of the contraventional liability and the contraventional sanction, preventing and fighting against contraventions, personal character of the contraventional liability).It is considered that „The contraventional process must contribute to the defense of the social and state order, the protection of public property, the strengthening of legality, the prevention of contraventions, as well as the education of citizens in the spirit of respect for the laws and the rules of social coexistence”.
