General Interest and Legal Protection of Software

Summary/Abstract: This paper offers a synthetic overview of the implications emerging from the general interest in the field of intellectual property law. The implications presented here were shaped out by the debates on the Proposal for a Directive of the European Parliament and of the Council on the patentability of computer implemented inventions (2002), and on the appropriateness of extending the patent system to computer programs. The Proposal has been rejected on July 6, 2005, after several years of debate and numerous conflicting amendments.
