Summary/Abstract: The right to build, as a new institute of property law, allows the use of someone else’s land plot for the construction of your own building. This right is at same time the property right on someone else’s land and the real estate in legal view, whereas the building is the appendix of right to build, as if the right itself is land. It is a legal instrument that makes possible the innovative management of land by controlling the way land is used, and controlling the construction as well. The more efficient use of natural resources of the local self-government units is possible by the public-private partnership. The institute of public-private partnership can be defined as the use of private investment/private money, as well as other resources, technical-technological and other know-how, with the purpose of investing it in creation/functioning of public goods, or provision of public services. The right to build is a suitable legal instrument for the implementation of public private partnership projects. The focus of this paper is on the legal framework of public-private partnership in Tuzla Canton.
