Summary/Abstract: The purpose of the study is to present the problem of conducting the vote during theCOVID-19 pandemic in a way that ensures the protection of fundamental rights, as far as theright to vote is concerned. This situation occurred in both Poland and France. In the first case, itinvolved the organization of presidential elections, and in the second – the transfer of the secondround of local elections. What is significant here is the observation of the approach of the consti-tutional courts to examining the issue of the constitutionality of the transfer of the election date.In Poland, the proceedings were discontinued, while in France, the Constitutional Council pro-ceeded to fairly assess the law’s compliance with the provisions of the Constitution of the FifthFrench Republic. The article juxtaposes the two legal orders and compares the ways of dealingwith the conduct of pandemic voting in the two countries.
