Summary/Abstract: The legal limits on the exercise of the property right must comply with both the express requirements laid down in the Civil Code and the requirements imposed by higher ranking normative acts, such as: The Romanian Constitution, the European Convention on Human Rights or the Charter of Fundamental Rights of the European Union. The existence of legal limits in the public interest leads to restrictions on the exercise of the prerogatives of private property rights, but the principle of proportionality must be respected.
