Summary/Abstract: The applicable Penal Code stands out with certain specific characteristics when it comes to preserving social values that concern our society. An overview of the current stage of criminal regulations highlights a number of objectionable means through which the Romanian legislator chose to protect these collective values. Thus, certain trends of systematization of insufficiently well motivated legal provisions, excessive conservatism within criminalization activities, unnecessary reduction of the number of incriminations that protect collective values and the emphasizing of the repressive nature and formality of criminal liability are all being highlighted. These debatable lines of evolution are simultaneously impacted by an increase in normative acts by which the guiding principles that underpinned the adoption of the current Penal Code happen to be blurred out.
